Ticket for not having completely stopped at a stopping sign !
Did Johann was the victim of an overzealous police officer? He gave her a nice little “ticket for not having completely stopped at a stopping sign” Zealous or not zealous… hard to say… Be the judge!

Hello, so here, it is the first time that I’ve decided to contest a ticket given by a Montreal police officer
. My story: (Situation: 3 stops crossroad… when I get to the stopping sign, I have the choice of going straight or turning left, since there is no street on the right). While I decelerate arriving at the stop in front of me I notice that the car ahead of me is stopped (the lady is flashing left) and the driver coming towards me is also stopped and allow her to turn in front of him.
Since she doesn’t get the message quickly, I have the time to get behind her and stop my car a few inches from the stopping line. I consider that since she had already passed the stop line when I arrived, and when I completely stop my car I was really only a few inches away from the line.
The lady in front of me finally turn and I slowly go forward without giving any gas, that’s when I realise that there is no one on my left, person that would had the priority, and so I pursue my journey. I only notice the police officer after I did my stop; he turned to follow me and allowed me to do the next stop to arrest me after. He told me that he wasn’t arresting me for this stop but for the one before this one… In sum, I consider that I wasn’t imprudent and that I did my stop! Do you believe that I have a chance of winning my case if a contest the ticket ?
Thank you,
Johann

My opinion:
Zealous or not zealous… we don’t care…
Indeed Johann, to my advice, the way you are telling your story, it is obvious that you made a complete stop… It is the car that was ahead of you that was in a bad position. Not you. And since the ticket is clear… the answer to your case is also clear…
However, don’t focus on telling the judge that the police officer explained this or that, even if he did a prohibited U-turn… all this won’t give any results. You need to focus only on what you did and what was the infraction. That’s all! The reading of your rights by the officer is not like when it’s an official arrested and he is taking you to the police office for detention… In that case, he must read your rights. It is not the same for a ticket.
For your defence at the courthouse you only need to convince the judge that you did your stop…
