Slipping at a stop sign ticket
Pascal’s story probably happened too many of you… a dusty snow… a slippery street… and hop! We are not
able to stop properly at the stop sign… crap! Here is his story as he told it…

if you want to, I would like to propose you my story like many other did. You can probably help me out. By the way, nice job, I like what you are doing. I discovered your website while I was on Google.
So here is my story : Sunday afternoon, January 25th 2009, near 1pm, since a dusty snow felt down during the night, I got in my vehicle with my girlfriend in order to do some quick purchases. I get out of my ward as usual and drive towards the crossroad near by my home in order to turn on my right. When I came to stop my car at the stop sign, my car started to slip, my ABS breaks are working and so my car wants to go straight ahead. So, seeing this is happening, I quickly look around me to make sure that I cannot endangered anyone near by, and turn my wheels so that my car turn right like I wanted while slowing down. Once I’ve turned and considering everybody is safe, I continued driving speeding up as usual pursuing towards my destination. A few seconds after my maneuver, wonderful red and blue flashing lights started illuminating the sky behind my vehicle.
The police just pulled me over for an omission of stopping at a stop sign. He takes my registrations and does the usual routine. I don’t even have time to explain. I tell myself that when he will come back, I will explain to him that the road was very slippery and that’s the reason why I wasn’t able to stop. But, that is not how things worked out. He gave me back my paper and tells me “There you go sir your ticket, but I was supportive of you, I didn’t want to affect your apprentice license class1”. I forgot to mention that I have an apprentice license for class1 and since my driver’s license is expiring next May, the condition to pass the test is that I mustn’t get more then 4points and I already lost 3 points for excessive speeding last July.
So, with this ticket, I have -2 so it is impossible for me to get my license, essential for my job since I’m a diesel mechanic. So the police officer, alone when he pulled me over by the way and hidden in a private parking lot behind a sort of van that was slightly blocking his sight tries to tell me that 3 points are not a big deal since it is not the same thing for class1 and class5 driver’s license. We can conclude that Sir police officer doesn’t know the law at all. I’ve tried to explain him, but he doesn’t understand that it doesn’t work this way. He doesn’t want to hear a thing. Before getting pissed, I calm down and he gave me the ticket. I didn’t even have time to explain way I wasn’t able to stop my car at the stop sign, he is already gone. So I find myself with a nice 154$ ticket, add 3points, that’s the way to start a day almost in your home ward.
I would like to get your opinion on my story and tell me if it will be plausible to contest. I mostly want to contest because of the slippery road in my case. I am waiting for your comments. Thank you in advance dear friend and have a good day!!! Pascal

Dear Pascal… it is a very particular situation… In your case, I believe that you need to contest not because of the money you will save but because of the points you need in order to get your next driving license…
You may need to get in touch with a lawyer…Start by the free consultations like I explain in the “lawyer” section… otherwise, if you want to contest yourself in front of the judge, don’t mention the law the police officer didn’t know… Focus on the facts that you were panelized for… Did you do or not your stop… in your case, it seems that you didn’t do it.
However, I believe that the judge could give you your case… you did want to stop but you were unable… Furthermore, where the police officer car was parked is not a fact in your case…
