Speeding ticket for cutting a three-lane road

Monday, February 8th, 2010

Argh ! A speeding ticket for cutting a three-lane road and passing on a red light… that’s expensive ! Ask Cedric !
**************

Hello,

My first case was in Quebec City, on the Bastien de la Colline Boulevard. I was driving at a 60km/h speed in a 50km/h zone and I was looking for the highway. I was on a three-lane road : the right one was for those who wanted to continue or turn right, the one in the middle was for those who wanted to continue or turn left and the left one was for turning left only. I was in the middle lane and one of my friends (we where 4 in the car) tell my “it’s right here!” So I quickly do my blind spots and I turn left (it was a bit quick but not excessive). I drive for about 1 minute and I get pulled over.

A rather young officer, just out of the academy, asks me if I think he’s stupid. I don’t understand right away and since I don’t know what he is talking about I tell him that I don’t understand why I would think that he is stupid. He tells me “You shortcut a three-lane road and turned left on a red light! That is why you should think that I am stupid.” My best friend and my girlfriend say at the same time “The light was green!” and I add that the middle lane is also made for left turns. The officer starts screaming and I don’t exaggerate, he really taught I was thinking that he was stupid. I really wanted to get caught in his little game he started…

I taught twice about it thinking it wasn’t worth it and stayed calm. I waited for this to come to an end. He finally adds “I am sure that you weren’t driving at the speed limit since it took me a lot of time to catch up”. I didn’t say anything to keep him calm since he really tried to piss us off. He tried to make me say something I didn’t do. We all were pretty offended. Later, I received a wonderful 154$ ticket and three demerit points by express mail. I am thinking if I should go get some help or can I defend myself with my witnesses?

The story of Sandra… Discussion about what really is following a vehicle at an imprudent and unreasonable distance

****************
Hello,
Thank you in advance for trying to help. Everyone one I have told my story to has been shocked and said they have never heard of anyone getting a ticket for this before. This was one overzealous cop. I am not sure whether I should contest or not. Can you help me decide?

Here is what happened:

Scooter parked in the bus zone Ticket

Wednesday, November 11th, 2009

It seems that Mike checked everything… but the policeman didn’t think the same thing… So he got a Scooter parked in the bus zone Ticket…

******
On November 7, 2009 I was accused of infringing Highway Safety Code c.C-24.2 Sec 386 Paragraph 5 “…[stopping] a road vehicle in a zone reserved exclusively for vehicles assigned for public transportation…” This took place on Avenue Mont-Royal in the Plateau, Montreal QC.

The sign indicating a bus stop zone is clearly marked, and there is an arrow that points to the left of the sign. To the right of the sign is a clearly marked municipal street parking zone, with paid meters.

There is a 1.2 meter space from the start of the bus stop zone sign to the markings on the pavement denoting the parking space. (I measured it).

I drive a scooter (under 49cc). My scooter is 65cm wide from handle bar to handle bar (it’s widest point) and 1.8 m in length from the front to back tire. Parked on an angle (facing the direction of traffic) as I was on that day, my vehicle can occupy anywhere between 1.1 m to 1.4m of space (depending also on the positioning of the handlebar and front tire). In other words, I can safely fit the vehicle within that small space before the bus stop sign and after the parking space.

Contribution for the victims of criminal acts

Friday, September 11th, 2009

What can define an infraction related to Quebec’s law on the behalf of a town’s rule? The importance is there concerning the contribution for the victims of criminal acts! Here is the question asked by Michel… If a reader already had this situation and contested this amount… tell us in order to help Michel!
**********

Hello, recently I got a ticket for prohibited parking in Longueil. 32$Fine +10$Fees+10$Contribution.

On the back of the ticket they define contribution : “ the contribution is an amount given to help the victims of criminal acts and adds up to the amount of the fine and fees requested on the infraction ticket for all infraction related to a Quebec’s law, there is an exception if the ticket delivered is related to a town’s rule. I taught that parking in the streets of a city was related to the city’s rules “. So the 10$ amount shouldn’t be requested since it is part of the exception.

What can I do ?

Thank you for your advices.

Michel

Ticket for stopping his vehicle

Wednesday, September 2nd, 2009

This case, told by a Montreal resident that I won’t name, is emotionally charged… let’s say that… this Poker player… let’s hope have more chance with his cards after getting this ticket for stopping his vehicle…
*****

Hello, I would like to share my story with the other readers of this blog. Before talking about my case, I would like to say that I’m living in a disadvantage area in Montreal, filled with ethnical minorities and we often get tickets that most people don’t pay and I never heard about the possibility of contesting. I would like to know how to do so that the police officer leaves us alone with all there stories like, putting a feet in the street at a crossroad when the light is red and that we are waiting for it to change green. Ticket for darkened windows

Saturday, August 22nd, 2009

By a nice sunny, but cold day, Daniel was driving with his girlfriend… Suddenly, coming out from nowhere, a police officer pulled him over and gave him a ticket for darkened windows! Guilty?
****

Hello, I was driving with my girlfriend last Saturday and we were looking for an ice cream place…It was very a nice day even if it was cold… we were up for some ice cream… the car windows were closed… when we weren’t driving fast, since we were in a small street near the river, I hear a siren…

I pull over in order to let the police car drive by, but she stops behind me… the police officer ask for my papers and don’t answer my questions on why he is arresting me… when he comes back, he gives me the ticket and tells me it’s because my windows are to darkened!

I didn’t even know that was possible! Why the guy at the garage accepted to put me this dye if it’s not even legal ?

Can I contest ?

Thank you,

Daniel
********

Did the police officer directly give you the ticket ? Did he measure the dye with a device ? Did he ask you to get somewhere to measure the degree of the dye ? You know that, know one must ignored the law… so the fact that you didn’t know will not convince the judge that you are innocent… It’s not like you just bought your car the day before… here is the information from the SAAQ website :

Contest a Sûreté du Québec ticket

Thursday, August 6th, 2009

A visitor of the website just got a ticket from an SQ agent and ask me about the procedure described on the website… well… how to contest a ticket from the sûreté du Québec?

The procedure seems to be quite de same… here are all the information that I’ve found.

When you get the ticket from an SQ agent, you must plead not guilty by mail and post it to the address found on the ticket or by using the SQ website.

Then, to contest, you must address by mail or by fax the following:
Bureau des infractions et amendes (BIA)
1200, route de l’Église Sainte-Foy
(Québec) G1V 4X1
Fax : (418) 644-8486

You need to give all the facts you can in order to prove that you are not guilty. Be very concise. Focus on you and what you did or didn’t do. You can also post pictures by mail.

You also need to give the following information :

  1. last name
  2. first name
  3. address
  4. city
  5. zip code
  6. ticket number
  7. you also need to write: “I plead not guilty”
  8. date the document and sign it your brief and concise facts.

Don’t wait too much before mailing it.

Following your request, you will get the results of the analysis by mail under the form of an explicative note. Then, following the exam of the BIA agents, your case will be transmitted to the prosecutor substitute. He will judge if this should be heard in front of the court and you will know either the date of the hearing or if the case was closed. Of course, you have the right to get a lawyer before your pleading.

If you want to obtain the communication of the evidence (article 168 to 186 of the Code de procédure pénale) you need to write a note:

- by fax at this number: (418) 644-8486;
- by mail or in person at this address:

Bureau des infractions et amendes
1200, route de l’Église Sainte-Foy
(Québec) G1V 4X1

– Or else you can also go to the local offices.

If you only want to get information, you can communicate by email or by phone at this number 1 877 263-6337 (AMENDES) (have your ticket number near). Those different procedures don’t modify the fact that you need to answer in the next 30 days to plead not guilty. Some communities manage SQ tickets. Communicate with the SQ if you want to know if your community does it.

How to obtain a copie of our driver’s report

Sunday, August 2nd, 2009

Did you know that the SAAQ keeps in her computer system tones of information related to you? Indeed, the society keeps all the information related to your last driving problems or difficulties…

But, you have the right to get a copy of this information. You will then be able to know what these facts are and recognize the information that is noted. Furthermore, this is a free service offered by the SAAQ. So, don’t hesitate, you only have to request it. I explain below how to get your driver report copy.

Go on the site SAAQ, go in the “services en ligne SAAQclic” section. You also can use the search engine of the site and write “demande de copie de dossier de conduite” in the research area.

Fill out the form by adding the information requested that appears on your driver’s license (your driver’s license number and the reference number). Indicate in witch language you want your report to be delivered and then click on the submit button.

There you go, you will receive your report by mail in a few days.

When I filled out my request, I received it 3 days later in my mailbox.
